Processing Times for Business Immigration Petitions: What to Expect And How to Avoid Surprises

For individuals and companies pursuing employment-based visa petitions, processing times are just as critical as eligibility. USCIS timelines vary by visa category and should be incorporated into any immigration strategy from the outset.

Understanding USCIS Processing Times

USCIS processing times reflect how long it typically takes the Agency to adjudicate a petition filing (a/k/a a benefits request). USCIS website indicates the Agency calculates these timelines based on how long it took to complete 80% of cases adjudicated during the previous six months.

The processing time is measured from the date USCIS receives a petition to the date it is approved (or denied) within that six-month period.

Why processing times vary

Processing times are not fixed and fluctuate based on several factors, including:

  • Staffing levels
  • Application and petition volumes
  • Policy and operational changes
  • Application type and case complexity

It is important to note that USCIS processing times are estimates, not guarantees.

How to Check USCIS Processing Times

USCIS publishes current estimates through its USCIS Case Processing Times Portal, which provides the latest data.

Please note, USCIS’s webpage on case processing times indicates that for certain form types the portal may no longer reference a specific service center location.

“USCIS is in the process of adjusting all processing times for service center-related forms to now list “Service Center Operations (SCOPS).” Service Center Operations has expanded its capability to process casework at multiple locations, at various points in time, based on business needs and staffing requirements. Therefore, listing a specific location is no longer an accurate representation of where a case is processed. USCIS is adjusting their case processing time metrics to provide the most accurate and up-to-date information by form type. While certain form processing times are now listed under Service Center Operations, you may continue to receive correspondence from USCIS listing a specific service center location”.

As of this writing, the following are the current estimated processing times relevant to business immigration petitions filed with routine processing, not including premium processing, which requires an additional USCIS filing fee and is further discussed below. Current USCIS Processing Time Estimates

Form I-129: Petition for a Nonimmigrant Worker

  • O-1, Extraordinary Ability: 9.5 months
  • L-1, Intracompany Transferees and Blanket L: 6 months
  • E-1/E-2, Treaty Traders and Investors: 10.5 months
  • TN, United States-Mexico-Canada Agreement (USMCA, formerly NAFTA) Professional: 3.5 months
  • H-1B-Visa to be issued abroad: 6.5 months

Form I-140: Immigrant Petition for Alien Workers

  • Extraordinary Ability: 21 months
  • Outstanding Professor or Researcher: 19 months
  • Multinational Executive or Manager: 21.5 months
  • Advanced Degree or Exceptional Ability: 5.5 months
  • Skilled Worker or Professional: 5 months
  • Advanced Degree or Exceptional Ability Requesting a National Interest Waiver: 22 months

Form I-485: Application to Register Permanent Residence or Adjust Status

  •  Employment-Based Adjustment: 11 to 30 months depending on the field office

Premium processing may be available for certain Form I-129 and Form I-140 petitions. This optional service requires an additional USCIS filing fee of $2,805 and guarantees adjudication within an expedited timeframe; if not, USCIS will refund the fee. Please note, the fee will be increased to $2,965 for petitions filed on or after March 1, 2026.

  • Most classifications: 15 business days
  • Exceptions:
    • EB-1C Multinational Executive/Manager (Form I-140): 45 business days
    • EB-2 National Interest Waiver (Form I-140): 45 business days

Premium processing can be a valuable strategic tool, but it is not available for all filings and does not guarantee approval.

How to Check Your Case Status

Actual case timelines may extend beyond posted estimates.  To check the status of a specific filing:

  1. Go to USCIS Case Status Online
  2. Enter the 13-character receipt number from your I-797C Receipt Notice (learn more)
  3. Click “Check Status” to view case updates.

When Processing Takes Longer Than Expected

Delays can occur even in well-prepared cases. Common factors that may impact adjudication timelines include:

  • Policy or regulatory changes affecting eligibility or review procedures
  • Application or filing errors
